刑事二審程序的若干問(wèn)題研究

摘要

刑事第2審程序作為普通救濟程序是刑事訴訟的獨立程序，也是整個(gè)刑事訴訟程序的重要環(huán)節。它對于查清案件事實(shí)，正確適用法律，維護司法權威，具有重要意義。由于我國現行刑事訴訟法關(guān)于第2審程序的規定過(guò)于簡(jiǎn)單、原則，相關(guān)司法解釋規定也較少，有很多地方需要完善和改進(jìn)。因此有必要在堅持刑事2審終審制的基礎上，分析刑事2審程序制度建構的價(jià)值基礎和功能，借鑒現代西方國家刑事2審制度的特點(diǎn)，針對我國刑事2審制度在立法和司法實(shí)踐中存在的問(wèn)題，提出完善的建議和措施。

The criminal second trial procedure took the ordinary relief procedure is the criminal prosecution independent procedure, also is the entire criminal prosecution procedure important link. It regarding investigates thoroughly the case fact, correctly is suitable the law, maintains the judicial authority, has the vital significance. Because our country present Law of Criminal Procedure about second trial procedure stipulation too simple, principle, the related judicial interpretation stipulation are also less, has very many places to need to consummate and the improvement. Therefore has the necessity in persisted criminal second trials trial in final the system in the foundation, the analysis criminal activity second trials procedures system constructs the construction the value foundation and the function, The model modern western nation criminal activity second trials systems characteristic, in view of our country criminal activity second trials systems the question which exists in the legislation and the judicial practice, puts forward the consummation proposal and the measure.
