“產(chǎn)品”概念的法律分析

摘要：產(chǎn)品作為1個(gè)歷史性和社會(huì )性的概念，從各種不同的角度，人們可以對此做出不同的分析。社會(huì )經(jīng)濟的發(fā)展，導致了產(chǎn)品損害事故不斷發(fā)生，而產(chǎn)品損害事故地不斷發(fā)生，則導致了專(zhuān)門(mén)解決產(chǎn)品損害事故所造成的損害賠償問(wèn)題的產(chǎn)品質(zhì)量責任和產(chǎn)品責任的產(chǎn)生�！爱a(chǎn)品”范圍的界定，關(guān)系著(zhù)產(chǎn)品質(zhì)量責任和產(chǎn)品責任的最終承擔，是產(chǎn)品責任法首先要解決的問(wèn)題。本文就以此為思路，首先從經(jīng)濟學(xué)和法律的角度對產(chǎn)品進(jìn)行了1番分析，接著(zhù)對比和區分了產(chǎn)品質(zhì)量責任和產(chǎn)品責任中的“產(chǎn)品”概念，最后，通過(guò)與西方諸國的比較研究，對我國《產(chǎn)品質(zhì)量法》中“產(chǎn)品”概念做出評價(jià)，并提出了幾種特殊物品應該歸入產(chǎn)品的范圍。

Abstract: The product is a historic and social concept, people can analysis the product from various different angles. With the development of the social economy, product accidents were constantly occurred. These resulted in the appearance of product quality liability and product liability ,in order to resolve the damage caused by the product accident. The define of" product" scope, relating to the final assumption of the product quality liability and the product liability, is the problem that the product quality law wants to resolve firstly. According to this thinking, firstly,the text analyses the product from the economic and legal angels; secondly contrasts and differentiates the define of" product" of the product quality liability and product liability; finally appraises the product definition of china product quality law, and points out that a few special goods should belong to the scope of the product of china product quality law.
