論刑事訴訟中公、檢、法3機關(guān)的關(guān)系

摘  要
：我國刑事訴訟中對抗制訴訟模式因素的借鑒與引入，推進(jìn)了我國司法體制尤其是審判方式的改革。但經(jīng)過(guò)10來(lái)年的檢驗，現行刑事訴訟法的缺陷和不足逐漸得以暴露。在刑事訴訟法的修改再次引起廣泛關(guān)注之時(shí)，有必要對我國刑事訴訟中公、檢、法3機關(guān)的關(guān)系之現狀進(jìn)行考察，結合西方兩大法系的理論與制度安排，提出改革我國刑事訴訟中3機關(guān)的關(guān)系的理論思考和制度設計。
