信息網(wǎng)絡(luò )傳播權的法律規制與制度完善

【內容提要】信息網(wǎng)絡(luò )傳播權是伴隨著(zhù)現代信息技術(shù)出現的新的傳播權類(lèi)型，國際社會(huì )在運用法律手段設置、調整和完善該類(lèi)權利及其運行方面進(jìn)行了有效探索，產(chǎn)生了一系列可供鑒戒的文本。我國《信息網(wǎng)絡(luò )傳播權保護條例》的出臺實(shí)現了該權利在我國的體系化規制，但它并不能解決網(wǎng)絡(luò )時(shí)代著(zhù)作權保護的所有題目，信息網(wǎng)絡(luò )傳播權法律規則應該在《著(zhù)作權法》的第二次修改中得到統籌考慮，并以此促進(jìn)《條例》的修改和完善。 【英文摘要】Along with the swift development of the Internet and the popularity of the computers, we have step into the information time. In the time, the development of high-tech brings unprecedented challenge for the traditional intellectual property right, especially the copyright law. It is the copyright holders who own the rights controlling the communication of the works, including the Right of Communication through Information Network. The relative regulations have been implemented in China as well as the other representative Countries. But we can't draw the definite conclusion that the regulations are perfect in this field. The article will discuss the second amendment of copyright law and relative byelaw on the Right of Communication through Information Network.
